TERMS AND CONDITIONS

FOR THE USE OF THE SERVICES OF THE PORTAL "WORKTALENT" BY APPLICANTS

  

"WORKTALENT" SA is a company registered under the Commercial Law of the Republic of Bulgaria with UIC 207852755, with registered office and management address: 19, Knyaz Aleksandar Dondukov - Korsakov, 4th floor, Sofia.

These TERMS AND CONDITIONS regulatethe relationship between WorkTalent SA (hereinafter referred to as WorkTalent or the Portal Administrator), on the one hand, and the Applicants - users of the WorkTalent.com internet portal administered by the company (hereinafter referred to as the Portal or the Platform).

These TERMS AND CONDITIONS constitute a contract for the provision by WORKTALENT of the SERVICES described below. The parties to the Contract are WORKTALENT - on the one hand, and a) a Visitor-Applicant who has not registered an account in the Portal, but who applies to an offer with Quick apply or/and Apply with LinkedIn profile or/and to an offer allowing an application on the Company's platform (with an external link); or b) a Applicant who has registered an account in the manner set out below.

 

І. GENERAL PROVISIONS

1. "WORKTALENT" is a platform for posting job and/or internship offers by Companies and a place for individuals to apply to offers.

For the purposes of these TERMS AND CONDITIONS, a Company is a person offering a Job/ Internship - an individual or legal entity or an Employment Intermediary within the meaning of the Employment Promotion Act.

2. The SERVICES shall be provided by WORKTALENT in accordance of these TERMS AND CONDITIONS.

3. The TERMS AND CONDITIONS may be updated at any time without specific notice to Visitor-Applicants and Applicants. WORKTALENT shall not be liable if the Visitor-Applicant or Applicant has not read the latest version of these TERMS AND CONDITIONS. The latest version of the TERMS AND CONDITIONS can be viewed at any time at: Terms and Conditions for the use of the services of the WORKTALENT portal by Applicants.

4. When using the SERVICES, the Visitor-Applicant/Applicant is obliged to comply with these TERMS AND CONDITIONS, as well as all other conditions set by the legislation of the Republic of Bulgaria and international legislation, even if not mentioned in these TERMS AND CONDITIONS.

5. WORKTALENT shall have the right to request that elements of user accounts be edited which, in its sole discretion, do not comply with the requirements of these TERMS AND CONDITIONS or the Privacy Policy.

6. The Visitor-Applicant/Applicant understands and accepts that the SERVICES are provided "as they are" and that WORKTALENT assumes no responsibility for the timeliness, deletion, failure to deliver or retention of the Visitor-Applicant/Applicant's personal settings or communications, as well as for damages, loss of profits and other damage occurring after, as a result of or due to the use (or inability to use due to technical problems, maintenance, administrator decisions, etc.) of the SERVICES. The exclusion and/or limitation of the liability of WORKTALENT shall apply to the extent possible under applicable law. In cases where, under applicable law, liability can only be limited, it shall be deemed to be limited to the extent possible (e.g., to intentional acts/omissions or those committed in gross negligence, where WORKTALENT is liable for negligent acts/omissions).

7. In order to use the SERVICES, the Visitor-Applicant/Applicant must access the World Wide Web directly or through other devices that access Web-based content. In addition, the Visitor-Applicant/Applicant must provide all equipment necessary to access the World Wide Web, including a computer, modem, or other means of accessing the Internet network. WORKTALENT shall only provide the SERVICES and shall not be responsible for any interference or technical problems preventing the use of the SERVICES due to the Visitor-Applicant/Applicant's operation of the computer equipment.

 

II. REGISTRATION OF APPLICANTS

1. Creation of a Applicant’s account is done personally.

2. An Applicant’s account may be closed: a) at the request of the person who registered the account or his authorized representative. b) at the initiative of WORKTALENT - when in his sole discretion the Applicant has violated these TERMS AND CONDITIONS or the law in using the SERVICES.

Closure of a Applicant's account deletes the data entered in the account as well as the Applicant's submitted applications (if any).

 3. By registering an account in the Portal, the Applicant makes an electronic statement, which concludes a contract with the SERVICES under these TERMS.

Upon termination of the Applicant's account, the contract between the Applicant and WORKTALENT for the use of the SERVICES shall be deemed terminated.

4. Registering an Applicant’saccount is done in several steps.

Step 1: The Applicant can choose one of three options to register an account: 1. By entering two names, email and password; 2. Login with a Facebook account; or 3. Login with a Google account. The Applicant declares that he/she agrees to the Terms and Conditions for the use of the services of the Portal WORKTALENT by Applicants, that he/she is familiar with the Terms and Conditions for the use of the WORKTALENT Portal, the Policy for the Protection of Personal Data of Individuals - Applicants and Visitors, and the Cookie Policy and confirms that he/she accepts them. By proceeding Forward, the Applicant's account has been created.

Step 2: Filling ib the following minimum required data for applying to the offers:

                - Photo (optional) - The applicant uploads a photo of himself/herself to the Platform;

                - CV (curriculum vitae) -may upload more than one CV. In his/her account, the Applicant will be able to see his uploaded CVs, can remove them and upload new ones. When applying for a specific job, the Applicant will be able to choose which of the uploaded CVs to attach.

                - Answer the following 6 questions (mandatory):

1. Date of birth - to establish the person's legal capacity.

2. At which University are you studying or have completed your studies? He/she can also choose the option "I am not studying and have not completed higher education";

3. Professional field in which you want to develop? - The Applicant chooses from a list, and may indicate more than one.

4. In which city are you looking for a job/internship? - The Applicant chooses from a list, and can indicate more than one.

5. Languages spoken? – The Applicant may choose from a list, and may indicate more than one.

6. Phone number to contact you? – enters a phone number.

The details completed in this step may be completed or edited by the Applicant at any time.

After clicking the „SUBMIT“ button, the Applicant can use all the functionalities of the platform requiring the registration of an account.

Step 3: Additional data in the Applicant’s Account to be filled in and applied in his/her applications at his/her own will:

- Video presentation - The Applicant uploads a video file with a video of himself/herself. Only one video can be uploaded for both Job and Internship offers. The video can be removed and uploaded by the Applicant at any time.

- Internship Pre-interview - 16 open questions;

- Job Pre-interview - 16 open questions;

- LinkedIn profile link;

5. The Video Presentation, the Job/Internship pre-interview and LinkedIn profile link are optional. Applicant may complete and attach them to their own applications as they wish.

6. The questions in the Preliminary Interview for Job and Internship are different. The answers will be editable by the Applicant. All questions must be answered for the Preliminary Interview to be complete.

7. In his/her account, the Applicant can see information about his/her applications, sorted from newest to oldest - which offer, which company he/she applied to, and what documents he/she sent. The Applicant can delete his/her application.

8. An Applicant may subscribe/unsubscribe to offers in one or more categories or from one or more Companies. When an offer is published in his/her chosen category or by his/her chosen Company, he/she will receive a notification to the email specified in his/her account with a link to the offer.

9. Applicants are responsible for the content of all information entered in their user account, in the documents they apply to an offer, as well as for that contained in links to other sites that they provide through the Portal.

III. OFFERS

А. Kinds of offers. Period of activity.

1. Job offer - active for 30 days from the time of its approval by Administrator. Upon expiration of the active period and if no action is taken by the Company (archive, renewal), the offer is automatically archive.

2. Internship offer - active for 90 days from the time of its approval by the Administrator. Upon expiration of the active period and if no action is taken by the Company (archive, renewal), the offer is automatically archive.

 

B. Types of offers

Offers are positioned according to their type and date of publication (from newest to oldest).

1. Free offer

1.1. Each Company is entitled to 10 free offers within a one-year period from the date of registration on the Platform.

1.2. Characteristics of a free ad:

- Application via an external link cannot be selected;

Cannot recommen attachment of Pre-interview and/or Video presentation by the Applicants;

- No additional questions to the Applicants can be included. 

2. Paid offers

2.1. There are three variants of paid offers: Classic, Premium and Premium Pro.

 

Features of Classic Ad:

- It is positioned above the Free and below the Premium listings;

- An external link application cannot be selected;

- Cannot recommend the attachment of Pre-Interview by the Applicants;

- Cannot recommend attachment of Video Presentation by the Applicants;

- No additional questions to the Applicants can be included.

 

Features of Premium offer:

- It is positioned above the Classic and below the Premium Pro offers;

- Applying on the Company's platform (via an external link) or on the Platform can be chosen;

- When applying on the Platform:

- May recommend attachment of Pre-Interview by the Applicants;

- May recommend attachment of Video Presentation by the Applicants;

- Applicants may be asked up to 5 additional questions;

 

Features of Premium Pro offer:

- It is positioned at the top;

- Applying on the Company's platform (via an external link) or on the Platform can be chosen;

- When applying on the Platform:

- May recommend attachment of Pre-Interview by the Applicants;

- May recommend attachment of Video Presentation by the Applicants;

- Applicants may be asked up to 15 additional questions.

 

2.2. When publishing a Premium or Premium Pro offer, the Company may choose between two ways of applying:

- On the Company's platform - via an External Link: the "Apply" button leads to an external link provided by the Company where it collects the information it needs from the Applicant in its own way. The link can also be opened by clicking on "Apply" by unregistered users - Visitor - Applicants, after filling in two names, phone number and email and agreeing to the General Terms and Conditions of Use of the WORKTALENT Portal, the General Terms and Conditions of Use of the WORKTALENT Portal Services by Applicants and the Privacy Policy for Individuals - Applicants and Visitors.

When selecting an External Link, the Company does not receive user data, there is no option for to recommend the attachment of a Pre-Interview and/or Video Presentation, there is no option to ask additional questions.

- In the Platform: the Company receives the applications in the Platform and has the possibility to use all the functionalities (Pre-interview , Video Presentation, Additional questions) available for the offer type.

2.3. When publishing a Premium Pro offer, the Company may enable Quick Application. Where the offer allows this, it is visually distinguished and has an additional "Quick Apply" button.

 

IV. APPLICATION TO AN OFFER

А. Applicants

1. The Applicant has access to the offers of all Companies and may apply to each of them only once, without any other restrictions. After reviewing and selecting an offer, the Applicant clicks on the "Apply" button.

2. If the offer collects the applications in the Platform, an option to select one CV (from the list of CVs of the Applicant) is displayed.

If the Company has taken the option to request a Pre-interview (for Job or Internship - depending on the type of offer) and/or a Video Presentation, these will be recommended and not mandatory. The Applicant will see that what is requested is a priority for the Company, but it will be up to the Applicant to decide whether to fulfill the requirement.

If the Company has taken the opportunity to ask additional questions - the questions appear with free response boxes (giving answers is recommended, not madatory).

3. After clicking the "Apply" button, the Applicant receives a confirmation that he/she has successfully applied to the offer. By submitting an application, the Applicant sends an electronic statement to the relevant Company.

4. Upon successful application, all available data (including optional data, if the applicant has chosen to provide them) related to the type of offer (Job or Internship) is sent to the Company. The Company receives an email notification that a new application has been received to the specific offer.

5. If the offer has an External Link, the button redirects to the location specified by the Company that posted the offer and the Platform role ends.

6. In its offer, the Company may provide a link to its own privacy policy for job/internship applicants and/or employees/interns or to other internal policies that will be applicable to the Applicant in the event that he/she takes up employment or an internship with the Company.

7. In the event that an Applicant deletes his/her application for a specific offer, it will no longer be visible to the Company that published it, Nevertheless, it is possible that the Company to whose offer the Applicant applied has retained his/her personal data contained in the documents and information sent by him/her in connection with the application. Pursuant to the Personal Data Protection Act, the Company, as a personal data controller, independently determines the storage period of personal data of Applicants, which in the cases provided for in the Personal Data Protection Act may not be longer than 6 months, unless the Applicant has consented to storage for a longer period. After the expiry of this period, the Company is obliged to delete or destroy the stored documents with personal data. WORKTALENT shall not be liable in any way for the determination and compliance with such time limits by the Companies, or for the processing of the Applicants' personal data by the Companies for/by the purposes and in the ways determined by the Companies.  

8. The Applicants' applications submitted to the Company's accounts on the Portal are automatically deleted from the Company's account after 6 (six) months from the date of application.

Б. Visitors - Applicants

1. Visitors-Applicants who do not have a registered account on the Platform may apply only to offers enabling application on the Company's platform (with an external link) and to offers with Quick Apply and/or Apply with LinkedIn profile. The ability to apply on a Company's Platform (with an external link) can be given in a Premium or Premium Pro offer.

 

2. In case of an offer with an application on the Company's platform (with an external link), after clicking on the "Apply" button, a form opens in which the Visitor-Applicant fills in the following mandatory data: two names, phone number and email, and agrees to the General Terms and Conditions for the use of the portal "WORKTALENT", the General Terms and Conditions for the use of the services of the portal "WORKTALENT" by Applicants and the Privacy Policy for individuals - Applicants and Visitors. The "Submit" button redirects it to the external link and WORKTALENT has no further relation to the application to the respective offer. WORKTALENT does not provide the Company with the data filled in by the Visitor-Applicant in the form.

 

3. When applying for an offer with Quick Apply, after clicking the button a form opens in which the Visitor-Applicant fills in: name (mandatory), phone number (mandatory), email (mandatory), brief presentation - free text up to 1000 characters (optional) and agrees to the General Terms and Conditions for the use of the portal "WORKTALENT", the General Terms and Conditions for the use of the services of the portal "WORKTALENT" by Applicants and Privacy Policy for individuals - Applicants and Visitors. WORKTALENT stores only the name, the phone number and the e-mail of the Visitor- Applicant and does not receive or store the other data filled by him in the form.. They are obtained by the Company that published the offer and are visible in the applications tothe offer in the "Quick Applications" section.

4. When applying for an offer with Apply with LinkedIn profile, after clicking the button a form opens in which the Visitor-Applicant fills in: name (mandatory), LinkedIn profile link (mandatory), phone number (optional), email (mandatory) and agrees to the General Terms and Conditions for the use of the portal "WORKTALENT", the General Terms and Conditions for the use of the services of the portal "WORKTALENT" by Applicants and Privacy Policy for individuals - Applicants and Visitors. WORKTALENT stores the name, the phone number(if provided), LinkedIn profile link and the e-mail of the Visitor- Applicant. The name, the phone number (if provided), LinkedIn profile link and the e-mail of the Visitor- Applicant are obtained by the Company that published the offer and are visible in the applications to the offer in the "Quick Applications" section.

5. By submitting an application, the Visitor-Applicant sends an electronic statement to the relevant Company.

6. In its offer, the Company may provide a link to its own privacy policy for job/internship applicants and/or employees/interns, or to other internal policies that will be applicable to the Visitor-Applicant in the event that he/she takes up employment or an internship with the Company.

7. Visitor-Applicant’s applications submitted to the Company's accounts on the Portal are automatically deleted from the Company's account after six (6) months from the date of application.

 

V. RIGHTS AND OBLIGATIONS OF APPLICANTS AND VISITORS- APPLICANTS

1. In consideration of the use of the SERVICES, Applicants, respectively - Visitor-Applicants agree :

(a) to provide true, accurate and up-to-date information when creating their account, or completing the application form for offers;

(b) to make changes to that data as necessary to ensure its accuracy, precision and actuality.

In the event that an Applicant provides false, inaccurate or outdated information, WORKTALENT shall have the right to close and/or delete the information and deny further access to some or all of the SERVICES.

2. Applicants:

a) create a username and password and gain access to the relevant SERVICES after completing the registration process.

b) are responsible for maintaining the confidentiality of the username and password created and are solely responsible for all activities accessed using their username and password.

c) agree to immediately notify WORKTALENT of any unauthorized use of their username and password, any other breach of security, and to terminate access to the SERVICES (log off) at the end of each session (after use).

d) In case of loss (forgetting) of the password, WORKTALENT will send to the e-mail registered by the User a link to create a new password.

e) WORKTALENT shall not be liable for any damages or losses arising from any failure to comply with the provisions of this clause.

f) Employees or representatives of WORKTALENT will never ask for an Applicant's password.

3. WORKTALENT will never send an Applicant or Visitor Applicant an e-mail that contains an Internet link leading to a page on which the Applicant must enter a username and password or an attachment that must be installed. If he/she receives such an e-mail on behalf of WORKTALENT, the Applicant or, respectively, the Visitor-Applicant shall immediately notify the WORKTALENT’s team by e-mail to contact@worktalent.com.

 

VI. BEHAVIOUR OF APPLICANTS AND VISITORS- APPLICANTS

1. Applicants and Visitors-Applicants understand that the information, data, text, photographs, images, videos, or any other materials (collectively, "CONTENT") that they submit or make available are the sole responsibility of the person who generated such Content.

2. Applicants and Visitors-Applicants using the SERVICES are solely responsible for the Content sent by email or otherwise transmitted through the Portal. WORKTALENT does not warrant the accuracy, integrity, truthfulness or nature of Content sent and distributed by Applicants and Visitors-Applicants through the SERVICES.

3. When using the SERVICES, the Applicants and Visitosr-Applicants are also obliged to comply with the obligations set out in Section III "CONDUCT OF USERS" of the General Rules for the use of the WORKTALENT Portal.

 

VII. DATA PROTECTION

1. What are the personal data that we process within our activities in connection with the Portal, for what purposes and on what grounds we carry out this processing is described in detail in the Policy for the Protection of Personal Data of Individuals - Applicants and Visitors, and in the Privacy Policy (for Companies), which also provide additional information and assistance in this regard.

2. WORKTALENT undertakes not to disclose any personal data of the Applicants and Visitors-Applicants and not to provide such information to third parties - government authorities, commercial companies, individuals and others, except when:

(a) obtained the Applicant's consent at registration (or, as the case may be, from the Visitor-Applicant when applying under an external link offer) or at a later time if consent is an applicable basis for a disclosure;

(b) the information has been requested by public authorities or officials who, under the legislation in force, are empowered to request and collect such information in accordance with legally established procedures;

c) other cases specified in the law or in the Policy for the Protection of Personal Data of Individuals - Applicants and Visitors.

3. By accepting these TERMS AND CONDITIONS, Applicants who have registered an account and Visitor-Applicants expressly agree that the personal data provided by them will be processed by WORKTALENT electronically in the event of a requested service delivery and in the event of a need for assistance by an employee of WORKTALENT.

4. WORKTALENT applies a Cookie Policy regarding the cookies used on the Portal. It supplements our Privacy Policies for Individuals - Applicants and Visitors, respectively - for Companies and the Terms and Conditions for the use of the WORKTALENT Portal by Applicants, respectively - by Companies and aims to inform Users why we use cookies, what they do and what choices Users have in relation to their use.

5. WORKTALENT reserves the right to use the IP addresses of Applicants and Visitors-Applicants to disclose their identities where necessary to comply with the law, legal process or to comply with these TERMS AND CONDITIONS.

 

VIII. OTHER PROVISIONS

1. The Applicant/Applicant-Visitor shall be liable in case of violation of these TERMS AND CONDITIONS and any violation of applicable law in the use of the Portal and its content and shall indemnify the CUSTOMER for all damages - damagesand lost profits suffered as a result of the violation, including for financial penalties paid, attorney's fees and other costs incurred as a result of claims brought by and/or damages paid to third parties.

2. In the event that any of the provisions of these TERMS AND CONDITIONS shall prove to be invalid, this shall not invalidate the TERMS AND CONDITIONS. The invalid clause will be superseded by mandatory rules of law or established practice.

3. The provisions of the current legislation of the Republic of Bulgaria shall apply to all matters not covered by these TERMS AND CONDITIONS.

4. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, all disputes arising out of the application of these TERMS AND CONDITIONS, including their interpretation, invalidity, performance, shall be settled by the competent court in the city of Sofia under the Bulgarian legislation in force.
