General rules

FOR THE USE OF THE PORTAL "WORKTALENT"

"WorkTalent" SA is a company registered under the Commercial Law of the Republic of Bulgaria with UIC 207852755, with registered office and management address. "Registered office and registered address: 19, Knyaz Aleksandar Dondukov - Korsakov, 4th floor.

These RULES apply to all users of the WorkTalent.com -the Internet portal administered by the Company (hereinafter referred to as the WORKTALENT, Portal or Platform). In addition to these RULES, the relevant Terms and Conditions of Use of the services of the portal "WORKTALENT" and the relevant Privacy Policy shall also apply to registered users of the Portal.

The User declares that he/she is familiar with these TERMS and any active action on his/her part or maintaining a passive behavior after the Portal is loaded in the browser constitutes an electronic declaration that he/she agrees with these TERMS.

An active action is a click/selection on an electronic link or banner, taking the User to other pages of the Portal. Passive behaviour means not leaving the Portal once it has loaded in the User's browser.

 

І. GENERAL PROVISIONS

1. "WORKTALENT is a platform for job and/or internship offers by Job Offerers and a place for individuals to apply for job offers.

2.  These RULES may be updated at any time without specific notice to Users. WORKTALENT shall not be liable if the User has not read the latest version of these TERMS. The latest version of the RULES can be viewed at any time at: General rules for the use of the portal "WORKTALENT".

3. When using the Portal, the User is obliged to comply with these RULES, as well as all other conditions set by the legislation of the Republic of Bulgaria and international legislation, even if not mentioned in these RULES.

4. In order to use the Portal, the User must access the World Wide Web directly or through other devices that access Web-based content. In addition, User must provide all equipment necessary to access the World Wide Web, including a computer, modem or other means of accessing the Internet network. WORKTALENT shall not be liable for any interference or technical problems preventing the use of the Portal due to the User's operation of the computer equipment.

 

II. CATEGORIES OF USERS

The users of the services are Visitors, Visitor- Applicants, Applicants and Companies.

1. A VISITOR is any person who loads the Portal in their web browser. Without registering an account, visitors can browse current internship/job offers using the provided search engine with filters.

2. A VISITOR - APPLICANT is a visitor who does not have a registered account on the Portal, but applies to an offer giving the opportunity to apply on a Company platform (with an external link) and/or to an offer with “Quick Apply” and/or to an offer with “Aplly with LinkedIn profile” .

3. AN APPLICANT is an able-bodied individual who has registered an account on the Portal. In case the APPLICANT is a person under 18 years of age, he/she may use the SERVICES only with the consent of his/her legal representative.

4. A COMPANY is an individual or a legal entity offering a Job and/or Internship  or an Employment Intermediary within the meaning of the Employment Promotion Act who has registered a profile on the Portal. It has the possibility to publish an unlimited number of internship and/or job offers. Only Companies that have registered an account on the Platform may publish offers.

5. SERVICES are those functionalities of the Portal that the respective User can use - for posting job and/or internship offers by Job Offerers or for applying to offers - depending on its quality as described above.

 

III. USRES BEHAVIOUR

1. Each User agrees NOT to use the Portal and/or the services offered through the Portal to:

a) formulate, store, send or otherwise transmit Content that is unlawful, harmful, threatening, abusive, discriminatory, harassing, injurious, defamatory, vulgar, obscene, indecent, defamatory, invasive of another's privacy or racially, ethnically or otherwise objectionable;

(b) harm children in any way;

(c) impersonate a person or group of people, including but not limited to: a representative of WORKTALENT, a forum leader, a directory, or a host, or otherwise misrepresent one's affiliation with a group of people or an individual;

(d) forge headers or otherwise manipulate identification means in order to disguise the origin of Content transmitted through the SERVICES;

e) formulate, store, send, publish or otherwise transmit Content that it is not entitled to transmit by law or as a result of other contractual or confidential relationships (such as inside information, confidential or proprietary information, or that is subject to non-disclosure agreements);

f) formulate, store, transmit, post or otherwise transmit Content that infringes any patent, trademark, copyright, proprietary right or any other right ("RIGHTS") of any person or third party;

g) formulate, store, send, post or otherwise transmit unauthorized advertising or promotional materials that are not related to the SERVICES, junk mail, spam, "chain letters", alias or redirect subdomains, "pyramid schemes" or other forms of attracting customers;

(h) formulate, store, send, publish or otherwise transmit materials containing computer viruses or other computer code, files or programs designed to interrupt, disrupt or limit the operation of computer software, hardware or telecommunications equipment;

(i) interfere with the normal operation of other users of the SERVICES, including, if not using the SERVICES, interfering in any other way that adversely affects the ability of other users to participate in real-time exchanges;

k) interferes with the provision of the SERVICES or disrupts the operation of servers or networks associated with the SERVICES, fail to comply with any requirements, procedures, policies or regulations of networks associated with the SERVICES;

(l) intentionally or unintentionally violate local, national or international laws;

m) obsess or otherwise harass another User;

n) collect and use information about other Users illegally;

o) collect or use content posted by a Applicant or Company for purposes inconsistent with the SERVICES provided on the Portal.

2. Users agree not to violate the rights and interests of WORKTALENT and third parties and not to commit malicious acts. "Malicious Acts" within the meaning of these RULES are acts or omissions leading to the unauthorized use or modification of the Portal and/or the contents of the Portal. Malicious acts are, but not limited to, modifying content, unlawful obtaining information, breaching security or maliciously exploiting system weaknesses and flaws (HACK), damaging or destroying systems or information arrays, functions and features of the Portal software (CRACK), sending Trojan horses or causing the installation of viruses or remote control systems, sending junk mail, overflowing channels, bypassing, damaging or otherwise interfering with the normal operation of technical or software applications and any other actions interfering with the normal operation of the Portal and the ability of other users to use the Portal, as well as performing any actions that may qualify as a violation under Bulgarian law.

3. In the event that the User fails to comply with any of its obligations under this Section for any reason for which he/she is responsible, or submits, publishes or makes available for publication material that violates the above requirements, legal provisions or rights of third parties, and any third party claims are brought against WORKTALENT or any financial penalties are imposed by government authorities or WORKTALENT incurs any costs and/or damages, the User shall immediately upon notice indemnify WORKTALENT for the penalties, claims, losses and expenses incurred, including court costs, attorney's fees, etc. WORKTALENT will take reasonable steps to ensure that the User is notified in a timely manner of such claims or proceedings for financial penalties and is afforded the opportunity to takе actions for legal protection.

4. For the safety and protection of the privacy of its Users, WORKTALENT informs parents and custodians that the SERVICES are made available to the general public and that it is their responsibility to determine the appropriate SERVICES for their children to use.

 5. By using the Services, Users may encounter Content that is offensive, indecent or objectionable. Under no circumstances will WORKTALENT be liable for any Content created by Applicants and Companies, including errors and omissions therein, and/or for any damages or harm of any nature incurred as a result of the use of Content displayed, posted, transmitted or otherwise made available through the SERVICES.

6. The personal data of the Applicants, as well as the representatives or contact persons designated by the Companies, may only be used in connection with the SERVICES. Users may not use such data for any other purpose.

IV. LIMITATION OF LIABILITY

1. WORKTALENT is not a recruitment agency, does not offer intermediary services within the meaning of the Employment Promotion Act, does not participate in the selection of Applicants, in the subsequent communication between the Applicants and the Companies, in the conduct of interviews, in the negotiations and conclusion of contracts between them.

2. WORKTALENT is not responsible for the performance of the obligations arising from the contracts concluded between the Applicants and the Companies, for the payment of the remuneration, taxes and social security contributions due thereunder.

3. WORKTALENT will not participate in the resolution of any disputes between the Applicants and the Companies arising out of the conclusion, validity or termination of the contracts between them.

4. WORKTALENT shall not be liable:

4.1. for inability to access the Portal or impaired functioning of the Portal, including for technical reasons, as a result of tests of technical resources and software, connections, networks, etc., as well as any other check or work on the Portal aimed at improving or revising the Portal and/or its content and/or improving or optimizing the SERVICES provided;

4.2. for the functioning of the Internet network and its connectivity to the end devices of the Users;

4.3. for the possible presence of "viruses" or other harmful effects of using the Portal;

4.4. for malicious acts of a User or a third party;

4.5. for other circumstances beyond the control of WORKTALENT - cases of force majeure, accidental events, problems in the global Internet network. Outside the control of WORKTALENT is also any act or omission of a User or third party, unauthorized access or intervention of third parties in the functioning of the information system or server, unavailability or malfunctioning of Internet connectivity or any other reason leading to degraded quality or inability to use the Portal undisturbed including, but not limited to, due to improper handling of technique and equipment by a User or third party, failure of a third party or a User to perform an obligation in connection with the use of the Portal, force majeure, etc.

4.6. for damage caused to the User's software, hardware or equipment, or for loss of data resulting from materials or resources searched, loaded or used in any way through the SERVICES provided.

4.7. WORKTALENT assumes no responsibility or liability for the identity, reputation and truthfulness or completeness of any other information submitted by the Applicants and Employers via the Platform.

5. WORKTALENT shall not be liable to the participants and users of the portal for any damages and lost profits resulting from:

5.1. termination, suspension, restriction of access to or modification of the Portal or the Resources or the SERVICES, or due to deletion, modification, restriction or inability to use the SERVICES or deletion or restriction of a User's profile.

5.2. the deletion, modification, loss, unreliability, inaccuracy or incompleteness of any message, material or information transmitted, used, recorded or made available through the Portal.

6. The exclusion and/or limitation of the liability of WORKTALENT shall apply to the extent possible under applicable law. In cases in which liability can only be limited under applicable law, liability shall be deemed to be limited to the extent possible (e.g. - to intentional acts/omissions or those committed in gross negligence, where WORKTALENT is liable for negligent acts/omissions). 

 

V. OTHER PROVISIONS

1. Users acknowledge and agree that their electronic statements to WORKTALENT and electronic statements from WORKTALENT to them shall be deemed to be signed by an ordinary electronic signature with the validityof a handwritten signature. The authorship of these statements will be established in accordance with the Electronic Document and Electronic Certification Services Act.

2. Users understand that they will be the recipients of electronic communications from WORKTALENT when, in connection with the SERVICES, communication between them and WORKTALENT via email is necessary.

3. WORKTALENT shall have the right to change the technology and design of the SERVICES provided without prior notice.

4. WORKTALENT reserves the right to send Users system messages related to new SERVICES, services related to the services used by the User or changes in the terms and ways of using the current SERVICES. WORKTALENT has the right to send unsolicited commercial messages to Users, presenting services or activities of WORKTALENT or third parties. The registered User has the right to opt-out of receiving these communications and the use of his/her data for direct marketing purposes at any time.

5. The advertisers are solely responsible for the content of all advertisements appearing on the Portal and for the trademarks they refer to.

6. Given the international nature of the Internet network and that the Portal is connected to this network, WORKTALENT does not guarantee that the flow of information to and from the Portal will not be monitored and recorded by third parties, despite the protection measures taken by WORKTALENT.

7. The User shall be liable in case of violation of these RULES and any violation of applicable law in the use of the Portal and its content and shall indemnify the WORKTALENT for all damages - losses suffered and lost profits, resulting from the violation, including for financial penalties paid, attorneys' fees and other costs, due to claims filed by and/or damages paid to third parties.

8. In the event that any of the provisions of these RULES are found to be invalid, this shall not invalidate the RULES. The invalid clause will be superseded by mandatory rules of law or established practice.

9. For all issues not covered by these RULES, the relevant General Terms and Conditions for the use of the services of the portal "WORKTALENT" or the relevant Privacy Policy, the provisions of the current legislation of the Republic of Bulgaria shall apply.

10. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, any unresolved disputes arising out of the application of these RULES, the respective General Terms and Conditions for the use of the services of the portal "WORKTALENT" or the respective Policy for the protection of personal data, including their interpretation, invalidity, performance will be resolved by the competent court under the Bulgarian legislation in force in the city of Sofia.
