TERMS AND CONDITIONS

FOR THE USE OF THE SERVICES OF THE PORTAL "WORKTALENT" BY COMPANIES

"WORKTALENT" SA is a company registered under the Commercial Law of the Republic of Bulgaria with UIC 207852755, with registered office and management address: 19, Knyaz Aleksandar Dondukov - Korsakov, 4th floor, Sofia.

These TERMS AND CONDITIONS regulate the relationship between WorkTalent SA (hereinafter referred to as WorkTalent), on the one hand, and the Companies - users of the WorkTalent.com internet portal administered by "WORKTALENT" SA (hereinafter referred to as the Portal or Platform).

These TERMS and CONDITIONS constitute a contract for the provision by "WORKTALENT" SA of the SERVICES described below. The parties to the Contract are WORKTALENT, on the one hand, and the Company, which has registered an account in the manner set out below.

For the purposes of these TERMS AND CONDITIONS, a Company is a person offering a Job/ Internship - an individual or legal entity or an Employment Intermediary within the meaning of the Employment Promotion Act.

 

І. GENERAL PROVISIONS

1. WORKTALENT is a platform for companies to post job and/or internship offers and a place for individuals to apply to offers.

2. The SERVICES shall be provided by WORKTALENT in accordance with these TERMS AND CONDITIONS.

3. The TERMS AND CONDITIONS may be updated at any time without specific notice to the Companies. WORKTALENT shall not be liable if the Company has not read the latest version of these TERMS AND CONDITIONS. The latest version of the TERMS AND CONDITIONS can be viewed at any time at: Terms and Conditions for the use of the services of the portal " WORKTALENT " by Companies.

4. When using the SERVICES, the Company undertakes to comply with these TERMS AND CONDITIONS, as well as all other conditions set by the legislation of the Republic of Bulgaria and international legislation, even if not mentioned in these TERMS AND CONDITIONS.

5. WORKTALENT shall have the right to refuse to post or to request the editing of postings or user account elements that, in its sole discretion, do not comply with the requirements of these TERMS AND CONDITIONS or the Privacy Policy.

6. The Company understands and accepts that the SERVICES are provided "as they are" and that WORKTALENT assumes no responsibility for the timeliness, deletion, failure to deliver or retention of the Company's personal settings or communications, or for any damages, lost profits or other damage occurring after, as a result of or due to the use (or inability to use due to technical problems, maintenance, administrator decisions, etc.) of the SERVICES. The exclusion and/or limitation of liability of WORKTALENT shall apply to the extent possible under applicable law. In cases where, according to applicable law, liability can only be limited, it shall be deemed limited to the extent possible (e.g. - to intentional acts/omissions or those committed with gross negligence, where the responsibility of the SERVICE is for negligent acts/omissions).

7. To use the SERVICES, the Company must access the World Wide Web directly or through other devices that access Web-based content. In addition, the Company must obtain all equipment necessary to access the World Wide Web, including a computer, modem or other means of accessing the Internet network. WORKTALENT shall only provide the SERVICES and shall not be responsible for any interference or technical problems thwarting the use of the SERVICES due to the exploitation of the computer equipment by the Company.

II. REGISTRATION OF COMPANIES

1. The creation of a Company's account shall be carried out by its legal representative or a person authorized by him.

2. A Company's account may be closed: a) at the request of the person who registered the account or his authorized representative, addressed to the Administrator of the Portal; b) at the initiative of WORKTALENT - when in his discretion the Company has violated these TERMS AND CONDITIONS or the law in using the SERVICES.

3. With the fact of registration of account in the Portal, the Company makes an electronic statement, thus concluding a contract with the WORKTALENT under these TERMS AND CONDITIONS. By registering its account, the Company declares that it agrees to these TERMS AND CONDITIONS, that it is aware of the General Terms and Conditions for the use of the portal " WORKTALENT", the Privacy Policy (for Companies) and the Cookie Policy and confirms that it accepts them.

Upon termination of the Company's account, the contract between the Company and WORKTALENT for the use of the SERVICES shall be deemed terminated.

4. Registering a Company account is done in several steps.

Step 1: The Company enters the e-mail that will be used to log in to the platform and a password. The Company declares that it agrees to the General Terms and Conditions for the use of the services of the portal "WORKTALENT" by Companies, that it is aware of the General Terms and Conditions for the use of the portal "WORKTALENT", the Privacy Policy (for Companies) and the Cookie Policy and confirms that it accepts them, after which a message appears that it will receive a link to confirm the registration on the specified email.

Step 2: After verifying its e-mail, the Company account is created and it is proceeded to the registration form.

Step 3: The Company enters the following mandatory data:

Identification details:

- Name of the Company and type of the Company (in Bulgarian) - according to the registration in the commercial or other register

- Company name (in foreign language)

- UIC/Bulstat

- VAT registration (Yes/No)

- VAT number (if registered)

- Registered office and management address – according to its registration

- Legal representative entered in the relevant register (optional field)

- Other - according to the type of Company.

Contact person:

- Name and Surname

- Business email

- Phone number

The completed contact person information is not published in the public account. A member of the WORKTALENT staff will contact the named person in case any questions occur.

Step 4:

Entering additional data about the Company:

- Sphere of activity (required field - select 1 to 3 spheres from the list provided by the platform)

- Description of the Company's activities (required field - free text up to 1000 characters)

- Address of the Company, if different from the address of registration (required field)

- Phone number (required field)

- Logo (option to attach a file with the company logo - optional field)

- Official Company website (optional field)

After pressing the "Submit" button, the Company can use all the features of the platform and publish offers.

2. The Company is responsible for the accuracy of all information filled in when creating the account. WORKTALENT does not verify that there is an actual legal entity behind the registered Company. Administrator will check that the details given when creating the account correspond to those entered in the commercial register and that the description of the business (in free text) is in the correct tone, etc. In the event of any discrepancies being found, WORKTALENT will notify the Company by the email and telephone number provided by the Company and the Company's offers will not be approved until such discrepancies have been rectified.

In the event that the account is created by a person that is not authorized, that person shall be responsible for the accuracy of all information provided when creating the account. The relevant provisions of the Law on Obligations and Contracts and the Commercial Law of the Republic of Bulgaria, including on the confirmation of actions without representative authority, shall apply.

3. The Companies are responsible for the content of the offers and all information entered in their user account, as well as that contained in links to other sites.

4. After registering an account, the Company can publish 4 types of offers.

5. After registration of an account, each Company receives the right to publish 10 free offers within a period of 1 year from the date of registration, as well as a one-time bonus of 20 credits (the equivalent of one "Classic" offer).

6.  Company account pages

6.1. "Conditions for publishing offers" page - contains detailed information on the types of offers and the method of publication.

6.2. “Buy/Add Credits” page - contains detailed information about prices, prepaid packages, payment methods, and ordering option.

6.3. “My Offers” page with several subsections:

“Active Offers” sub-page -Each record will contain information on Offer Title, Reference Number (if entered by the Company), Posting Date, Expiration Date, For Job or Internship, Location, Category, Employment Type, Number of Applications, New Applications, and other additional data.

Upon click on the offer, all applications for that offer will be loaded, sorted by date and time received from newest to oldest. New (unopened) applications are visually distinguished. The company can view the application on the platform as well as download the CV and Pre-Interview (if attached).

There are Edit, Archive, Renew, Duplicate offer options.

● For Edit, the Company clicks the "Edit" button, makes the requested changes, and then clicks the "Submit for Approval" button. After editing, the offer must be approved again by an Administrator.

● When attempting to Backup, a warning appears requesting consent that once the offer is backed up, it is considered expired and the action is irreversible.

● Renewal is only possible on the last day of the offer's activity. The renewal is considered as posting a new offer.

● Duplicate - loads the offer data into a new offer form.

 

“Archived offers” sub-page - all Archived/Expired offers are stored here. It contains information about Offer Title, Posting Date, Archived/Expired Date, For Job or Internship, Applications, etc. Offers are sorted by expiration date (newest to oldest). Upon click on an offer, all applications to that offer are loaded, sorted by date and time received from newest to oldest. New (unopened) applications are visually distinguished. The Company can view the application on the platform, as well as download a CV and Pre-Interview (if attached).

There are Edit, Duplicate, Delete offer options. When attempting to delete, a warning appears asking for consent that after deletion the Company will not have access to the offer and the applications to it.

 

“Pending Approval” sub-page - this is where offers that have been submitted for publication but are awaiting confirmation from an Administrator are stored.

The offer has a status of "Pending Approval". Upon approval, it automatically moves to the "Active Offers" sub-page and takes on all the characteristics of an active offer.

In the event of disapproval, the Administrator shall notify the Company of the reason. The Company edits as necessary and resubmits the offer for approval. The Administrator will be able to monitor the history of the offer to check what should have been changed.

 

"Drafts" sub-page - here offers saved as Drafts for the Company to finalize and publish at any time are stored.

 

6.4. “Order History” page - contains information related to all orders placed so far:

● What was ordered and on which date.

● Order status - Paid / Unpaid.

● Related documents with the order - proforma, invoice.

 

6.5 “Balance history” Page - contains debit/credit information on the Company's credit balance.

6.6. Account settings - allows changes to the password, edit login data, etc.

6.7. Quick Contact with Administrator - After clicking on the "Quick Contact with Administrator" button, a form appears with mandatory fields for filling in phone number, short description and option to attach a photo. After sending the message, an Administrator contacts the Company at the phone number provided.

 

III. PAID MODULES

1. Additional modules may be supported in the Company's account, the content of which is uploaded and administrated by WORKTALENT.

2. The creation of additional modules is ordered through the Platform by clicking "Unlock Module" and after payment for the selected module with credits from the Company's balance. After unlocking a module, an Administrator contacts the Company to clarify the details of the content. The Company sends the necessary information and the Administrator creates and publishes the content of the relevant module.

3. The modules are paid for by credits from the Company's balance sheet.

4. Categories of modules:

4.1. Module "About the company":

- can be ordered for a period of 1, 3, 6 or 12 months. The period starts after the module is published.

- positions the Company in General Partners on the Platform homepage while the period is active.

The period starts after the publication of the module. If it is not renewed, the module shall be hidden from the Company's account that is visible by users and the Company ceases to be positioned in General Partners. Hiding happens automatically when the period expires. The content is not deleted but remains in the Company's account as an archived/expired module. The Company can renew it via the "Unlock Module" button in the order described above.

 

4.2. Module "Company news":

- a number of articles (1-5) is ordered, without being bound to a period.

- does not position the Company in General Partners on the Platform homepage.

- the articles ordered can be additionally promoted in the "On Focus" section on the front page of the platform within the first 7 days of their publication.

- articles remain available on the Company's account visible to users until the Company requests the removal of an article it has indicated.

 

4.3. Module "Our Team":

- can be ordered for a period of 1, 3, 6 or 12 months. The period starts after the module is published.

- positions the Company in General Partners on the Platform homepage while the period is active.

The period starts after the publication of the module. If it is not renewed, the module shall be hidden from the Company's account visible by users and the Company ceases to be positioned in General Partners. Hiding happens automatically when the period expires. The content is not deleted but remains in the Company's account as an archived/expired module. The Company can renew it via the "Unlock Module" button as described above.

 

4.4. Module "Company Activities":

- can be ordered for a period of 1, 3, 6 or 12 months. The period starts after the module is published.

- positions the Company in General Partners on the Platform homepage while the period is active.

The period starts after the publication of the module. If it is not renewed, the module is hidden from the Company's account visible by users and the Company ceases to be positioned in General Partners. Hide occurs automatically when the period expires. The content is not deleted but remains in the Company's account as an archived/expired module. The Company can renew it via the "Unlock Module" button as described above.

 

4.5. Module “Full Company Profile”:

- can be ordered for periods of 1, 3, 6 or 12 months. The period starts after the module is published.

- positions the company in General Partners on the Platform homepage while the period is active;

- receives all the modules described above in 4.1.-4.4, and for the module "Company news" receives the right to 1, 2, 3 or 5 articles depending on the selected period;

- if the module is not renewed, everything is hidden except the articles in the " Company news" module;

If it is not renewed, the modules described above in points 4.1.-4.4 are hidden from the Company's account visible by users - except for the articles in the " Company news " module, and the Company ceases to be positioned in General Partners.

 

5. Each paid module is uploaded to the Company's account by an Administrator. The Company receives instructions on formats/size that it must provide to WORKTALENT in order for the modules to be formatted in its account. Video can be uploaded both as a video file and as a YouTube link.

6. In General Partners (top employers section on the homepage), Companies are sorted by the budget in the “About the Company”, “Our Team”, “Company Activities” and “Full Company Profile” modules.

7. In its account the Company has information about its paid modules and their period of activity.

 

IV. PUBLICATION OF OFFERS

А. Kinds of offers. Period of activity.

1. Job offer - active for 30 days from the time of its approval by Administrator. Upon expiration of the active period and if no action is taken by the Company (backup, renewal), the offer is automatically archive and moved to the "Archived Offers“ sub-page.

2. Internship offer - active for 90 days from the time of its approval by Administrator. Upon expiration of the active period and if no action is taken by the Company (backup, renewal), the offer is automatically archive and moved to the "Archived Offers“ sub-page.

3. For both types of offers, if there is one day of the activity period left, the Company receives a system email that the specific offer will expire soon. 

4. When an expired offer is automatically backed up, the Company receives a system email that the specific offer has expired and been backed up.

 

B. Types of offers

Offers are positioned according to their type and date of publication (from newest to oldest).

 

 

"Quick apply": Quick application enables users without registration (Visitor- Applicants) to apply for each offer, after clicking the button a form opens in which he fills in: two names (mandatory), phone number (mandatory), email ( mandatory), short presentation - free text up to 1000 characters (optional) The data is received by the Company and is visible in the "Quick applications" section.

"Apply with a LinkedIn profile": Applying with a LinkedIn profile enables users without registration (Visitor- Applicants) to apply for each offer, after clicking the button a form opens in which he fills in: a link to his LinkedIn profile (mandatory), two names (mandatory), , email (mandatory), phone number (optional). The data is received by the Company and is visible in the "LinkedIn" section.

1. Free offer

1.1. Each Company is entitled to 10 free offers within a one-year period from the date of registration on the Platform. The Company's account contains information of the number of free offers available for use and the date until which they can be used. After the period expires, the free offers counter becomes 10 again for the next annual period, regardless of whether and how many free offers remain from the previous annual period.

1.2. Characteristics of a free offer:

- Application via an external link cannot be selected;

- Cannot recommen attachment of Pre-Interview and/or Video presentation by the Applicants;

- No additional questions to the Applicants can be included.

 

2. Paid offers

2.1. There are three variants of paid offers: Classic, Premium and Premium Pro. The prices of the paid offers are specified in the "Price List", which WORKTALENT has the right to change unilaterally according to its commercial policy.

 

Features of Classic offer:

- It is positioned above the Free and below the Premium offers;

- An external link application cannot be selected;

- Cannot recommend the attachment of Pre-Interview by the Applicants;

- Cannot recommend attachment of Video Business Card by the Applicants;

- No additional questions to the Applicants can be included.

 

Features of Premium offer:

- It is positioned above the Classic and below the Premium Pro offers;

- Applying on the Company's platform (via an external link) or on the Platform can be chosen;

- When applying on the Platform:

- May recommend attachment of Pre-Interview by the Applicants;

- May recommend attachment of Video Business Card by the Applicants;

- Applicants may be asked up to 5 additional questions;

 

Features of Premium Pro Offer:

- It is positioned at the top;

- Applying on the Company's platform (via an external link) or on the Platform can be chosen;

- When applying on the Platform:

- May recommend attachment of Pre-Interview by the Applicants;

- May recommend attachment of Video Business Card by the Applicants;

- Applicants may be asked up to 15 additional questions;

- The option "Quick Apply" can be selected. When the offer provides this option, it is visually distinguished and there is an additional "Quick Apply" button. Quick Application allows unregistered users (Visitor - applicants) to apply to the offer.

 

2.2. Payment method. The prices of the credits are set out in a "Price List", which WORKTALENT is entitled to change unilaterally in accordance with its commercial policy.

 

2.3. Credits can be used to pay for offers and paid modules.

2.4. Credits are not limited to a period in which they must be used. Once purchased and loaded onto the Company's balance, credits cannot be transferred from one Company to another. Unused credits cannot be refunded or withdrawn as a cash equivalent.

2.5 The Company selects and orders a prepaid package/number of credits from the menu, receives a pro forma invoice in its account and pays it by bank transfer. The credits are loaded into her account after payment validation by Administrator.

2.6. The Company may pay for its offer with pre-purchased credits (if any) or at unit prices set out in the "Price List".

2.7. When publishing a Premium or Premium Pro offer, the Company may choose between two ways of applying:

- Via External Link - the "Apply" button leads to an external link provided by the Company where it collects the information it needs from the Applicant in its own way. The link can also be opened by unregistered users(Visitor - Applicants) by clicking on "Apply".When selecting the External link, the Company does not receive any user data, there is no option to recommend the attachment of Pre-Interview and/or Video Business Card from the Applicants, there is no option to ask additional questions to the Applicants.

- In the Platform - The company receives the applications in the Platform and has the possibility to use all the functionalities (Pre-interview , Video presentation, Additional questions) available for the offer type.

2.8. On receipt of any new application under an offer, the Company shall receive notification by email that a new application has been received under the relevant offer.

2.9. The applications of the Applicants/Visitor – Applicants submitted to the Company's account on the Portal are automatically deleted from the Company's account after the expiry of six (6) months from the date of application.

C. Form for publishing an offer

1. When creating an offer, the following fields are filled in:

● Offer type - For Job or For Internship;

● Title of the offer (position) - free text;

● Ability to work remotely - YES/NO/HYBRID;

● Category - selection from a list of categories set by the Platform;

● Location - selection from a list set by the Platform;

● Type of employment - choice from a list set by the platform (Full/Part time, project work)

● Reference number - (the Company creates it itself, for easier traceability of its own offers) - optional field;

● Description - free text;

● Photo - optional.

● External link (if the Company has selected the application option in its platform)

In its offer, the Company may provide a link to its own Privacy Policy for Job/Internship Applicants and/or Employees/Interns, or to its other internal policies that will be applicable to the Applicant in the event that he/she takes up employment or an internship with the Company.

It is advisable that the offer contains contact details for matters relating to the protection of Applicants' personal data.

2. The Offer Type and Offer Title fields cannot be edited by the Company while the offer is in the Active status. They can only be edited by an Administrator.

Once the offer is published (submitted for approval), the Company will not be able to change its type (Free, Classic, Premium, Premium Pro)

3. Any new or edited offer must be approved by an Administrator before being posted. If disapproved by an Administrator, the offer will be returned to the Company for editing.

4. The Administrator may refuse to approve the offer and return it to the Company for editing if it does not comply with the Offer Posting Terms available on the Company's account.

 

D. Status of the offer

- Active

- Archived

- Pending Administrator’s approval

- Draft

 

E. Actions with offers

1. Archive (applicable to Active Offers). After archiving, the offer is considered expired and moved to the "Archived offers" sub-page. An offer may be archived at any time during its Active Period, and any unused days are at the Company's expense.

2. Renewal (applicable to Active Offers). The function is active only on the last day of the Active offer Period. Renewal is considered as publishing a new offer.

3. Edit (applicable to Active and Archived offers as well as Drafts). Not all parts of the Active Offer can be edited. After each edit, the offer is subject to approval by an Administrator. Editing an offer does not affect its display order or its active period.

4. Duplication (applicable to Active and Archived offers). Duplicates the offer data in the form to post a new offer.

5. Delete (applicable to Archived offers and Drafts). Deletes the offer along with its applications (if any).

 

V. RIGHTS AND OBLIGATIONS OF COMPANIES

1. In consideration of the use of the SERVICES, the Companies agree to:

a) provide true, accurate and up-to-date information when creating their account, respectively - when filling in the form for posting offers;

b) to make changes to that data as necessary to ensure its accuracy, precision, actuality and completeness.

In the event that the Company provides false, inaccurate or outdated information, the WORKTALENT shall have the right to close and/or delete the information and deny further access to some or all of the SERVICES.

2. The companies:

a) create a username and password and gain access to the relevant SERVICES after completing the registration process.

b) are responsible for maintaining the confidentiality of the username and password received and are fully responsible for all activities accessed using their username, password and email.

c) agree to immediately notify WORKTALENT of any unauthorized use of their username and password, any other breach of security, and to terminate access to the SERVICES (log off) at the end of each session (after use).

d) In case of loss (forgetting) of the PASSWORD, the WORKTALENT will send to the registered e-mail a link to create a new password.

e) WORKTALENT shall not be liable for any damages or losses arising from any failure to comply with the provisions of this clause.

f) Employees or representatives of WORKTALENT will never ask for a Company's password.

g) WORKTALENT will never send the Company an e-mail that contains an Internet link leading to a page where it must enter a username and password or an attachment that must be installed. If the Company receives such an e-mail on behalf of WORKTALENT, it shall immediately notify WORKTALENT’s team by e-mail to contact@worktalent.com.

3. Companies are Controllers in respect of the personal data of Applicants who apply to their job or internship offers and are responsible for the lawful processing of such data from the moment the application reaches the Company Account. They process this data in accordance with their own Privacy Policies and in compliance with all applicable legal requirements.

Notwithstanding the foregoing, the Companies shall not process the Data in a manner and for purposes incompatible with the SERVICES - selecting Applicants for employment or internship, conducting interviews, conducting negotiations and identifying an Applicant to be invited to employment or internship, unless they obtain the Applicant's express consent to do so. Companies as data controllers are not entitled to store, respectively - are obliged to promptly delete personal data of Applicants, the basis for the processing of which has ceased.

4. WORKTALENT does not process personal data on behalf of the Companies, respectively - does not have the capacity of a processor within the meaning of Article 28 of the General Data Protection Regulation.

 

VI. COMPANY BEHAVIOUR

1. The Companies understand that the information, data, text, photographs, images, videos, or any other materials (collectively, "CONTENT") that they submit, make available, make public, or transmit confidentially are the sole responsibility of the person who generates such Content.

2. The companies using the SERVICES are solely responsible for the Content sent by email or otherwise transmitted through the Portal. WORKTALENT does not warrant the accuracy, integrity, truthfulness or nature of the Content sent and distributed by Companies through the SERVICES.

3. When using the SERVICES, the Companies are also obliged to comply with the obligations set out in Section III "CONDUCT OF USERS" of the General Rules for the use of the WORKTALENT Portal.

 

VII. DATA PROTECTION

1. What personal data we process in the course of our activities in connection with the Portal, for what purposes and on what grounds we carry out this processing is described in detail in the Privacy Policy (for Companies) and the Privacy Policy (for Applicants), which also provide additional information and assistance in this regard.

2. By accepting these TERMS AND CONDITIONS, the Companies that have registered an account agree that the personal data of their representatives or contact persons provided by them may be processed by WORKTALENT electronically - in the event of a requested service delivery and in the event of the need for assistance by an employee of WORKTALENT.

5. All data voluntarily provided by the Companies and other data that identifies their representatives or contact persons in the process of using the SERVICES shall be stored, processed and used by WORKTALENT and other Users for the purposes and in the manner described in the Privacy Policy (for Companies) and the Privacy Policy (for Applicants).

6. WORKTALENT applies a Cookie Policy regarding the cookies used on the Portal. It supplements our Privacy Policy for Companies, respectively - for Applicants and the General Terms and Conditions for the use of the portal " WORKTALENT " by Companies, respectively - by Applicants and aims to inform Users why we use cookies, what they do and what choices Users have in relation to their use.

7. WORKTALENT reserves the right to use the IP addresses of Companies to disclose their identities where necessary to comply with the law, legal process or to comply with these TERMS AND CONDITIONS.

 

VIII. OTHER PROVISIONS

1. The COMPANY shall be liable in the event of breach of these TERMS AND CONDITIONS and any violation of applicable law in the use of the Portal and its content and shall indemnify the COMPANY for all damages - damages and lost profits, resulting from the breach, including penalties, attorneys' fees and other costs incurred as a result of claims brought by and/or damages paid to third parties.

2. In the event that any of the provisions of these TERMS AND CONDITIONS shall prove to be invalid, this shall not invalidate the TERMS AND CONDITIONS. The invalid clause will be superseded by mandatory rules of law or established practice.

3. The provisions of the current legislation of the Republic of Bulgaria shall apply to all matters not covered by these TERMS AND CONDITIONS.

4. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, all unresolved disputes arising out of the application of these TERMS AND CONDITIONS, including their interpretation, invalidity, performance, shall be resolved by the competent court under the Bulgarian legislation in force in the city of Sofia.
